If my loved one has been Baker Acted in the past, will they automatically be Baker Acted again if I call the police?

This message came through the Baker Act Attorney’s website, and I thought it was a terrific question, so kudos to the person who sent it to me. Basically, that individual indicates they had been Baker acted in the past and were afraid that if the police came to their house, they would automatically get Baker acted. Somebody had told them that you know it’s automatic, so I’m here to clear that up and tell you that it isn’t true.

First of all, there’s no limit on how many times you can get Baker acted, but I would say from a practical point of view that if you have been Baker acted before and you’ve been allowed to leave there at some point, the state’s going to decide that they need to keep you and you won’t be getting out so quickly. There’s nothing automatic about it, but you’ve been baker-acted a number of times, and the police come over to your house. You are exhibiting signs that establish that you continue to meet criteria; there’s a chance they will Baker act you. But still, there’s nothing automatic about it. Anybody who tells you anything to the contrary respectfully doesn’t know what they’re talking about. Each time you get Baker Acted you are supposed to meet the criteria. If you don’t, they’re not supposed to baker act you regardless of whether or not you’ve been Baker acted in the past.

Anyway, that was a great question. I always encourage people to send me questions. As you can see, I love talking about this topic. I may not have a real personal life because I’m making a lot of videos about the Baker Act, but I like to think I’m helping people.
