What should I do if the police come banging on your door because you have been Baker Acted?


Hello, everyone. It’s Mark, and welcome back to our video newsletter.

In this video, I want to talk about what you should do if the police come banging on your door with a Baker Act order and that they are looking to take you to a Baker Act facility.

Just this week, I got a call from somebody who said that the police had come banging on his door. They informed somebody else who was living in the house that they were there to execute a Baker Act pick-up order, and he wanted to know how he could avoid the police and avoid the court order. And so my response was, “Look, I am a lawyer. I represent many people stuck in Baker Act facilities, but I’m also an officer of the court, and as such, I’m not going to counsel you on how to avoid a court order. If the police come banging on your door and they are looking to execute a court order, I’m going to suggest to you that you need to comply with that order. I’m not going to tell you how to avoid the police if they have a court order in hand. If a judge has reviewed an application to have you picked up, I’m not going to counsel you on how to avoid that. What I can counsel you is that if somebody has made false allegations against you, there is a time in a place where I can help you address those allegations.”

That’s what we do here at Baker Act attorneys. I will help you to fight an unlawful and illegal Baker Act. Suppose somebody has lied in a sworn application to a judge; in that case, I’m more than happy to call that person out for you. I’m more than happy to point out to a judge that somebody has lied to the court, but I’m not going to counsel you on how to avoid a court order or how to thumb your nose at a judge.
