Can a medical condition cause my loved one to be Baker Acted?

Let me share the example that came before us. I had a call from a mother about her daughter who had taken one of the COVID 19 vaccines and, within 24 hours, was exhibiting all kinds of psychotic things. She was having problems with her speech; she couldn’t walk properly, she seemed disorientated. She was in and out of consciousness, and she ended up in the hospital. The facility baker acted her. They kept her. She was there for four or five days before they released her. Then, about a week or two weeks later, she went for the second dose of the vaccine injection, and within 24 hours, she was exhibiting the same symptoms she had the first time. Of course, nobody had connected the two, and nobody realized what was going on, but needless to say, she ended up back in the hospital, and the facility baker acted her again. This time, they kept her for even longer. I think when the call came in, she’d already been there for a week. At that point, one of the doctors said this might be connected to the vaccine, and needless to say, we’re not going to let her go. They were Baker acting her. The mother said she didn’t try to harm herself, and she didn’t try to harm anybody else. The doctor said we’re going to transfer her to another facility and let them decide whether or not she meets Baker Act criteria. The mother called me frantic.

I filed this case within two hours of calling me. I filed a petition for Habeas Corpus to have a judge order someone to release her. Within 24 hours, she was out. The facility has nearly been caught with her hand in the cookie jar. They knew that what they were doing was illegal. They were just milking her insurance.

This is just one example of a medical condition, you know, potentially confused with some mental health issue. I don’t believe that this woman ever met Baker Act criteria for one second. I found some research online, which we presented to the court wherein we confirmed our suspicions that this one COVID vaccine can cause an issue that makes the person appear like they were having some, frankly, a mental health issue.

Look. This isn’t you. I’m sure this is not the only example and I’m not pointing fingers at anybody who’s taken a vaccine. But, the long and short of it is sometimes, things can get confusing. When somebody has what appears to be a mental health issue, it’s not always crystal clear. As a result, because there is such abuse in the Baker Act system, it led to abuse in this particular case.
