What do I do if I feel like my rights are being violated?


Hello, everyone. It’s Mark, and welcome back.

In this video, I want to talk to you about your rights and your loved one’s rights. So, this is chapter 394, about 125 pages. This is full of rights—rights that your loved one is granted when they’re baker acted, and rights that you’re granted when your loved one is baker acted.

I get calls from families all the time saying their rights have been violated. I’m like, I get it. What do you want to do about it? They said we don’t understand. I said, these are rights, but all this is paper with ink on it. If you want your rights to be recognized, you’re going to enforce them. What I mean by that is, you need to go into court and get a judge to enforce your rights, for your loved one wants to have their right to freedom. I can tell you that inadequate Baker Act facilities are more than happy to trample on the rights outlined in chapter 394 of the baker act. So I understand rights are getting violated, but the whole principle of rights has to be enforced for them to have merit.

I also see a call from people saying they have a power of attorney and a health care policy. My loved one was granted the right to make medical decisions, and the bankrupt facility does not recognize them. And I said, what do you want to do about that? The state’s right to baker act your actual loved one and keep them trumps your rights. If you want to enforce, rights are given to us by the constitution; rights are given to us by statute; rights are granted to you by your loved one, then unless the facility is going to recognize them, you and I wouldn’t even be having this discussion. You need to go to court and enforce your rights. That’s the process. I’m here to help you to make sure that you get them. We have to go to court and have a judge recognize them and enforce them.
